Agreement: 

The terms and conditions set forth below, together with any additional documentation we give you, and any additional terms and conditions of any Supplier that are applicable to your travel arrangement (“The Agreement”), constitute the entire understanding and agreement between you the trip “Participant” and JN Adventures LLC dba JUMP Adventures “JUMP Adventures” with respect to any and all bookings, tours or transactions made with JUMP Adventures.  The Agreement describes what you are legally entitled to expect from us when you book your trip through us, in addition to important obligations you enter into as a participant that affect your legal rights.  Therefore, it is of vital importance that you read everything we provide to you in their entirety.  You must be at least 18 years old to participate in our trips.

By submitting a booking form, you accept all of the terms in this agreement and direct us to perform services on your behalf. All persons named in this booking (“Participants”) are subject to this agreement. By making a booking, you affirm that you have made all other Participants listed in the booking aware of these terms – regardless of how final payment is made – and that all Participants accept these terms. JUMP Adventures is not responsible for any participant’s unawareness of the Terms and Conditions due to the failure of the lead participant to share this information with all participants in the booking.  If you do not agree with our terms and conditions you must speak with us before making any booking.

Reservations:

You may reserve space on a tour by submitting an online booking form. A booking is not final until you receive a final confirmation from us.  

Deposits and Final Payment:

Planning travel takes time and effort and many costs are incurred before you ever depart, therefore a non-refundable planning fee of $850 per person is required at the time of booking. Final payment is due according to payment schedule of reserved departure, but no less than 75 days prior to departure. If your booking is made within 75 days of departure, the entire tour cost must be paid upon booking.

If we do not receive any payment due in full and on time, we reserve the right to treat your booking as cancelled by you in which case the cancellation charges set out below will become payable. We reserve the right to refuse a booking without giving any reason and shall, in that event only, return any deposit received. Reservations are transferable at the sole discretion of JUMP Adventures.

Air travel is not included in the price of the trip and cancellation charges for air travel will be governed by the terms and conditions of the airline.  Participants must NOT purchase air travel tickets to or from the destination until the booking is confirmed.  If participants purchase air travel before confirmation is received and the trip is then cancelled either by the participant or by JUMP Adventures, we will not be responsible for the expense of the ticket.

Payments may be made by credit card or bank transfer. Credit card fees are paid by the Participant. Bank transfers do not incur a fee, however if you pay by bank transfer, we cannot confirm your reservation until your payment has cleared the bank (5-7 business days).  All payments are processed through WeTravel.  

By authorizing payments through WeTravel you acknowledge that the charges made by you are legitimate charges, and you will not challenge any legitimate charges made. In the event of a participant initiating any chargeback or attempt to reverse your credit card for these legitimate charges, you will be responsible for any court costs or losses incurred by JUMP Adventures to recover those funds, including, without limitation, attorney fees.

What’s Included in a Tour

Accommodations

Accommodations are provided as detailed in your itinerary. Accommodation may be on board ship, lodges, and other unique experiences. Special requests such as single rooms, lower floors, connecting rooms and smoking preference, must be made at the time of booking.  While we will make reasonable efforts to communicate your requests to the supplier, such requests are not guaranteed and are at the discretion of the supplier. There may be additional charges for such requests which will be solely the expense of the participant making the request.

Participants should be aware that hotel room sizes, standards and facilities can vary regionally and are often different from standards in the United States.  This can include difference in bed sizes and room sizes, bathroom amenities, amenities such as air-conditioning and compliance with other standards such as ADA and wheelchair accessibility.  One of the joys of international travel is experiencing different cultures and different ways of life, so we hope that you will accept these differences with grace and a sense of adventure.

JUMP Adventures reserves the right, if necessary, to substitute other similar hotels for hotels listed on your itinerary. Such substitutions may be made at any time and without prior notice. We cannot be held responsible for hotel over-bookings; should such occur, we will undertake to find similar accommodations in the same area. Such substitutions are at JUMP Adventures sole discretion and no refunds will be offered for changes in accommodations.

While we exercise due diligence in the selection of our partners, hotel and other accommodation profiles are based on information provided to us by the supplier.  This includes images and descriptions of the properties and rooms.  Additionally, participants should be aware that star ratings or similar systems are based on country classifications and therefore can differ.  While JUMP Adventures does its best to maintain current and accurate information regarding these suppliers, we cannot be held responsible for any inaccuracies in supplier descriptions, amenities, or images.

Meals and Activities

Meals are as indicated in the itineraries.  Special diets should be requested at the time of booking; however, it may not be possible for special diets to be catered to in some of the destinations we feature. For safety and liability reasons, JUMP Adventures and its representatives cannot be responsible for directly accommodating any food allergies, or dietary requirements and restrictions, and is not responsible for any issues or problems associated with the same. We will advise the hotels of your request but we cannot guarantee their availability.

Activities:

Activities are included as provided in the individual itineraries.  As a courtesy to others in the tour, it is mandatory that you be on time for all scheduled experiences.  Activities will begin on-time and failure to arrive will be considered a no-show for which no refunds will be available.  At times, early morning departure times may help create a better experience. Therefore, late arrivals cannot be accommodated.  

What’s Not Included in a Tour:

Any items and matters not referred to in your itinerary are not included in the tour price. This can include, but is not limited to items such as airfare, checked and/or excess baggage; transfers, passport and visa fees; trip protection and/or insurances of all kinds; laundry; phone calls; minibar; beverages and meals not detailed in the itinerary; optional experiences; and all items of a personal nature. Additional taxes and surcharges may be collected by foreign governmental and non-governmental entities. The price does not cover costs and expenses, including your return home, if you leave the tour whether of your own volition, our decision based on behavior that disrupts the trip, due to illness, action by any government or other reason. This list is illustrative and not a complete list of every item not included.

Changes to Itineraries:

JUMP Adventures reserves the right to make changes to its published itineraries which we deem insignificant and are due to reasons beyond our control. In such cases, we will arrange for the substitution of comparable services. 

While no changes are anticipated, there may be occasions when certain alterations become necessary.  These can be due to religious holidays, national celebrations, or unforeseen events including weather, governmental closures, acts of God, or any other reason. JUMP Adventures reserves the right to change the itinerary due to such unforeseen circumstances or emergencies. These changes will not be considered a material changes and will not be considered cause for cancellation by the participant.  

If we suggest alternate activities in place of a planned stop or in case of leisure time, such suggestions do not constitute our endorsement.  In such a case you will be subject to the terms and conditions of the supplier of the activity and your only recourse in case of damage will be against the supplier of the alternate activity.

Cancellations by You and Refunds

As described above, JUMP Adventures is required to pay all suppliers well in advance of your tour date.  This includes but is not limited to accommodations, meals, transportation, guides, etc. All suppliers have their own cancellation policies, which apply to your booking. To cancel your booking, you must submit your request to us in writing by email at support@jumpadventures.com. Upon, receipt, JUMP Adventures will work with suppliers to recover any applicable refunds as outlined in the supplier’s terms and subject to their review. If you are entitled to a refund, please note that the supplier is responsible for this refund, not JUMP Adventures. Suppliers may choose to provide a travel voucher or credit in lieu of refund.  We are not responsible for a supplier’s failure to pay a refund or for supplier bankruptcy or insolvency.

In addition to the terms of our suppliers cancellation fees will be applied per person according to the following schedule, based on the date we receive your written notification:

  • Deposit ($850 per person) is non-refundable for all cancellations.
  • Prior to 75 days before departure, trip balance (not including non-refundable deposit and any non-refundable payments made to suppliers) may be refunded in full only if trip is sold out and a new and previously unregistered participant books your canceled spot and pays in full.
  • For cancellations made on or after the final due date, no money will be refunded.

No refunds will be provided for any unused portion of a tour once the tour begins, including if you leave a tour for any reason or have to be removed from a tour. There are no exceptions to this cancellation and refund policy, including for reasons related to weather, terrorism, civil strife, personal, family or medical emergencies or any other circumstances beyond our control. For this reason, we strongly encourage you to purchase trip cancellation and interruption protection. 

Cancellations or Changes by Us and Flexibility:

We reserve the right to cancel, alter or modify any tour without prior noticefor any reason, especially for the safety and/or comfort of  participants. You acknowledge that the amenities, accommodations, transportation, route, schedule, and itinerary may change without prior notice due to local circumstances or events, which may include mechanical breakdown, flight cancellations, illness, strikes, political disputes, weather, border crossing problems, and other unforeseeable factors. If, prior to departure, we make a significant change because of a problem with a supplier (e.g., bankruptcy), we will, as soon as reasonably possible, notify you of available alternatives.  

Any changes may require a supplemental payment from you or result in a refund less any cancellation fees and nonrefundable deposits. If we cancel, which is rare, a full refund will be issued to you less any nonrefundable deposits advanced to local suppliers. This refund will constitute full settlement of claims you may have arising out of our cancellation. No refunds under this paragraph will be provided due to cancellations or changes due to Force Majeure.

Non-Operation of Group Tours:

All tours are based on a minimum number of participants.  JUMP Adventures makes every effort to ensure that tours meet their minimum requirements.  However, if the tour drops below the minimum number of participants cancellation of the tour may occur at the sole discretion of JUMP Adventures.  In such case, participants will be advised at least 45 days prior to departure.  JUMP Adventures reserves the right to change the departure date. We may offer alternative tour dates or other travel arrangements.  You may choose to accept these arrangements or to cancel your booking, in which case a full refund will be provided.  Any air cancellation will be in accordance with the terms of the carrier and JUMP Adventures will not be liable for the carrier’s refusal to make any refund whatsoever.  In such case JUMP Adventures will not be liable for any additional costs incurred outside of the tour prices such as visa and passport fees, travel insurance or any other purchases made by the participant in anticipation of the tour.

Price Adjustments: 

The quoted tour price is based on tariffs, fees, exchange rates, and costs in effect at the time you sign this agreement. We reserve the right to increase the quoted price after booking if inflation, costs of fuel, labor or materials, supplier costs, currency exchange rates, tariffs, government fees, and admission charges change. You agree to and will pay for any price increase.

No Refunds for Personal Expenses:

You will not be reimbursed for any personal expenses such as airfare, hotel or other travel expenses due to changes in itineraries or tour cancellations.

Responsibility:

JUMP Adventures acts only as an intermediary for the various independent suppliers that provide lodging, meals, transportation, sightseeing, activities or other goods and services connected with your tour (“Supplier” or “Suppliers”). You acknowledge that you are aware and clearly understand that these Suppliers are independent contractors, are not managed by JUMP Adventures, and are not agents or employees of JUMP Adventures. A Supplier’s services are subject to the Supplier’s own terms and conditions and the local laws and regulations of the relevant country.  JUMP Adventures will not provide any refund for a Supplier’s delay, cancellation, overbooking, or strike.

Force Majeure:

JUMP Adventures will not be deemed in breach of this agreement or otherwise liable to you, by reason of delay in performance or nonperformance of any of its obligations under this agreement to the extent that any such delay or nonperformance is due to any Force Majeure. “Force Majeure” means any circumstances beyond the reasonable control of JUMP Adventures, including without limitation acts of God, terrorist activities, insurrection, explosion, flood, tempest, forceful wind, fire or accident, earthquake, volcanic explosion, tropical storms or hurricanes,  war or threat of war declared or undeclared, sabotage, terrorist threat, civil disturbance, labor strikes, requisition, epidemic, pandemic, quarantine, government health advisories,  government intervention, weather conditions, and any other similar unforeseen circumstances beyond the control of JUMP Adventures 

If JUMP Adventures and/or any of its Suppliers are affected by Force Majeure, they shall be entitled to, and may in their sole discretion, vary or cancel any itinerary or arrangement in relation to the tour. Regarding civil unrest, once JUMP Adventures has investigated the prevailing situation, as it deems fit, it shall remain in JUMP Adventures’ sole and absolute discretion whether to proceed with the tour.  In all cases of Force Majeure, JUMP Adventures will have no obligation to make a refund. However, we may choose to offer a travel voucher for future travel or provide a refund in accordance with the cancellation fee schedule above.  No Party shall have any other claim of whatsoever nature against the other in such circumstances.

Travel Protection:

The tour price does not include travel protection coverage. We strongly recommend that you purchase cancel for any reason travel insurance or comprehensive travel protection covering trip interruption and cancellation, baggage, accident/life, evacuation, repatriation and other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you. You agree to assume all costs of medical care and transportation. As such, we require that you purchase travel-related medical insurance if your current medical policy does not cover you during your tour. We may require proof of coverage.  Declining travel protection plan coverage could result in the loss of your travel cost and/or require more money to correct the situation. You acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred.

If you choose to travel without adequate coverage, we will not be liable for any of your losses howsoever arising, for which trip protection coverage would otherwise have been available.

Pre-Departure Documentation

It is important that you carefully read all trip-related documents and communications that you receive from us as soon as you receive them. It is your responsibility to contact us if any information is incorrect. We cannot accept any liability if you do not notify us of any inaccuracies within 14 days of your receipt of those documents. A waiver of liability and assumption of risk agreement and, if required, a medical statement or certification must be signed and submitted by you. If you fail to submit this and other necessary documentation prior to departure, we reserve the right to treat your booking as cancelled by you and impose the cancellation fees described in this agreement.

Destinations:

Travel to many parts of the world may involve the risk of a variety of hazards to health and/or safety, including but not limited to disease, crime, terrorism, and warfare. Because each participant’s risk tolerance is different, JUMP Adventures is not in a position to advise or recommend whether travel to any particular place at any particular time should take place. You should refer to objective third-party sources of travel information, such as that maintained by the U.S. Department of State (travel.state.gov) to make decisions about travel. In addition, you should consult with government websites in the country you plan to travel to ensure that you are in compliance with all requirements for admittance into that country as well as understanding local laws that govern travel within the country, such as tracking. Should you choose to travel to a country that has been issued a travel warning or advisory, JUMP Adventures will not be liable for damages or losses that result from travel to such destinations.

Passports and Visas: 

You are responsible for ensuring that all necessary travel documents are valid and effective and in your possession for the entire tour. Passports are required for all U.S. citizens traveling abroad and should be valid for at least 6 months after your date of return. We suggest you apply for or renew a passport early. Other required documents may include visas, permits, vaccination certificates, or proof of negative COVID-19 test results. You assume complete and full responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements. You are also solely responsible for any adverse consequences resulting from incomplete or defective documentation. While we may provide information or advice on matters such as visas, vaccinations, climate, clothing, baggage, and special equipment in good faith as a courtesy to you, we are not responsible for any errors or omissions as to the information provided.  

Health Requirements and Medical Care: 

Our tours are physically active, with varying levels of demands and fitness requirements depending on the specific itinerary. By making a booking, you represent that you do not have any physical or other conditions that would create a hazard for you or other Participants or affect other people’s enjoyment of the tour. If you are over the age of 65 and have a pre-existing medical condition, you must complete our medical statement. If you do not return the completed statement to us by the specified deadline, we reserve the right to prohibit you from departing on the tour and to charge a cancellation fee. If you have a physical condition, dietary restrictions, or other conditions that will require special attention during the tour, you must inform us in writing when the booking is made. JUMP Adventures will make reasonable efforts to accommodate requests, but cannot be responsible if ADA accommodations are not available.  Any accommodations provided will be at the sole expense of the participant requiring the accommodation. Please note that accommodations outside of the USA may not be in compliance with the Americans with Disabilities Act and may not have wheelchair accessibility. JUMP Adventures, tour guides, leaders and suppliers are, unfortunately, unable to offer additional assistance to participants with limited mobility and all such assistance will need to be provided by whoever the participant is traveling with. Participants with disabilities must notify JUMP Adventures at the time of booking of status and of the identity of their non-discounted, paid travel companion who will be responsible for providing all necessary assistance.

We may require a medical certificate if you have a special condition. We reserve the right in our sole discretion to accept, decline, or remove anyone from a tour (at departure or during the tour) who we judge to be incapable of meeting the tour’s physical demands.  

JUMP Adventures assumes no responsibility for any medical care provided to you. You agree to assume all costs of medical care and related transportation that are provided to you during the tour.  

Complaint Procedure: 

If you have a complaint during your tour, you must promptly notify  JUMP Adventures or your tour guide of the problem so that they can attempt to remedy the situation. Failure to do so while you are on the tour will extinguish or reduce your ability to claim compensation from JUMP Adventures. Further, if you attempt to address the problem on your own without using this notice procedure, you assume responsibility for any added costs you may incur and forfeit any potential refunds.

If you are not satisfied after using this notice procedure, you must submit your complaint in writing to JUMP Adventures within 7 days of the tour’s end date. JUMP Adventures will not accept any liability for claims received after this period.

Tour Start Date:

It is your responsibility to be ready to embark on the tour as specified in the itinerary. JUMP Adventures is not responsible for any losses due to cancelled or missed flights, changed flight itineraries, late arrivals, or early departures.

Compliance with Local Laws and Tour Etiquette:

You must strictly comply with all local laws, respect local customs and culture, accurately assess your abilities, respect other trip members’ privacy, and follow the suggestions and advice of any assigned guide. The decision of the local guide or local supplier is final on all matters that may threaten the safety or interfere with the well-being of others. During or prior to the tour, JUMP Adventures or the local guide/supplier has the right in its sole discretion to remove anyone a) who it judges to be incapable of meeting the demands and requirements of participating in the tour activities; or b) who it determines to detract from others’ enjoyment of the tour.

When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation owner or manager or other supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. JUMP Adventures is not responsible for any costs incurred concerning a participant removed from a vacation. 

Image and Video Release:

You agree that JUMP Adventures may use, re-use and reproduce any images, photos or videos that you send to us, or that are taken by our guides and/or other participants of you individually or in a group, in any medium, including but not limited to print, electronic media, or Internet, free of charge and without your right to inspection, for promoting and publicizing our travel products and services worldwide. If you do not want us to use any images of you that are taken by us or other participants during the tour, you must inform us or your tour leader in writing before the start of the tour.

Limitation of Remedies: 

You agree that the sole remedy for any default by JUMP Adventures arising under this agreement shall be the return of the paid tour cost. To the maximum extent permitted under applicable law, JUMP Adventures shall not be liable for any special, consequential, indirect, incidental or other damages arising out of or in any way connected to this agreement, including lost profits, whether such damages arise in contract, negligence, tort, under statute, in equity, at law, or otherwise, even if JUMP Adventures has been advised of the possibility of such damages. You expressly waive any right you may have to recover such damages.

Severability: 

If any provision of this agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of the original provision.

Successors and Assigns:

This agreement shall inure to the benefit of and be binding upon JUMP Adventures and the Participant and their respective heirs, legal personal representatives, successors and assigns.

Updating of Terms and Conditions: 

You acknowledge and agree that we may change these Terms and Conditions from time to time and that those changes become effective immediately. If we make material changes, we will provide you notice. Your continued use of our services following the notice of any changes constitutes your acceptance and agreement to be bound by such changes.  You agree to be bound by the Terms and Conditions that are in effect at the time of travel or cancellation. It is your responsibility to be familiar with these terms and conditions. Applicable Law and Choice of Forum:

Any dispute arising out of this agreement, including all tort claims – whether such dispute arises in contract or in tort or otherwise – shall be resolved exclusively by the state and federal courts located in Bozeman, Montana. The laws of the State of Montana, USA, govern this agreement.  You agree that you will only bring claims against JUMP Adventures in your individual capacity and not as a plaintiff or class member in and purported class action or representative proceeding. JUMP Adventures shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a tour means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against JUMP Adventures unless you have first provided a typewritten notice of claim to JUMP Adventures within 7 days after the tour or cancellation of the tour.
